Law As a Method of Conflict Resolution in Academe

Abstract

The growth of the " law industry" and the escalation of litigiousness are characteristics of contemporary American life. Hyperactivity in legal behavior and the emergence of a "law ridden" society need to be understood within the broad context of social change. After considering the processes and trends leading to the increasing legalization of conf1ict management, the paper documents and analyzes the progressive encroachment of the judiciary into academe as a ligitimate means of conflict resolution. An investigation of both the impetus for these conf1icts and the resulting types of lawsuits predominant in contemporary academe serves as an antecedent to the consideration of the implications of these developments for the future of American postsecondary education.
